Joint and Several Liability

When you rent to cotenants (even if husband and wife—divorces do happen), include a "joint and several liability" clause. This clause makes all tenants individually responsible for all rents and tenant damages.

Without joint and several liability, individual cotenants often claim that they're liable only for "their part of the rent." Or alternatively, "I didn't burn that hole in the carpet. Jones did. Collect from him." Often in such cases, Jones has already moved out and disappeared. Joint and several liability at least gives you the legal right to force payment from whichever other tenants have the money.
